TERMS OF SERVICE – Fox and Talbot

Welcome to Fox and Talbot. By accessing our website foxandtalbot.com or purchasing photographic from us, you agree to be bound by these Terms of Service (“Terms”). These Terms govern all website use, orders, and transactions with Fox and Talbot. If you do not agree, do not use the site or purchase products from us.

  1. Business Identity and Governing Law
    Fox and Talbot operates out of British Columbia, Canada. These Terms and any separate agreements are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein.

  2. Equipment and Condition Ratings
    All inventory sold by Fox and Talbot is pre-owned (used). We do not sell new equipment unless stated as such.

  • Condition Descriptions: We provide detailed condition ratings for every item. These ratings are subjective and represent our professional assessment of the item’s mechanical and cosmetic state.

  • Images: Photos show the actual item unless marked as a Stock Photo.

  • Expectation of Use: Minor cosmetic wear or internal dust consistent with normal use is not considered a defect and is not covered under warranty.

  1. Pricing, Currency, and Taxes

  • Currency: All prices are displayed in Canadian [CAD]. Payment in other currencies may be converted at the current exchange rate.

  • Taxes: GST/HST and/or PST will be applied for Canadian customers based on the province of delivery. British Columbia residents will be charged applicable PST and GST.

  • Errors: We reserve the right to cancel orders arising from obvious pricing errors or technical glitches.

  1. International Orders and Customs
    For customers outside of Canada:

  • Importer of Record: You are responsible for ensuring the product can be lawfully imported.

  • Duties and Fees: You are responsible for all customs duties, VAT, import taxes, and brokerage fees. These are not included in our shipping rates and are usually collected by the carrier.

  • Refusal of Delivery: Refusing a shipment due to import fees may result in deductions for return shipping and restocking fees from any refund.

  • Delays: Fox and Talbot is not responsible for delays or additional charges caused by customs, import inspections, carrier issues, weather, natural disasters, acts of God, war, strikes, labor disputes, or any other events beyond our reasonable control.

  1. Transfer of Risk and Title
    Ownership and the risk of loss or damage pass to the buyer when the package is marked as Delivered by the shipping carrier. All shipments require a signature at delivery. By completing a purchase, you acknowledge and accept responsibility for your order upon carrier delivery.

  2. Returns, Warranty, and As-Is Sales
    Our Returns and Warranty Policy governs all performance, returns, and warranty claims for used equipment:

  • 88-Calendar Day Confirmed Operation Warranty: Covers mechanical or electrical defects not noted in the original listing.

  • As-Is Sales: Items marked As-Is or For Parts/Repair are final sale and carry no warranty.

  • Return Shipping: Buyers are responsible for safe packaging when returning items. Failure to comply with packaging guidelines may affect your refund.

  1. Limitation of Liability
    To the fullest extent permitted under British Columbia law:

  • Products and the website are provided “as-is” and “as-available.”

  • Fox and Talbot is not liable for indirect, incidental, or consequential damages, including loss of income, data, or equipment function.

  • Total liability for any claim will not exceed the purchase price paid for the specific product.

  • Some jurisdictions do not allow certain exclusions; liability is limited to the greatest extent permitted by law.

  1. General Provisions

  • Severability: If any part of these Terms is unenforceable, the remainder remains in effect.

  • Force Majeure: We are not liable for delays or failures caused by events beyond our control, including natural disasters, strikes, or postal disruptions.

  • Entire Agreement: These Terms, along with our Privacy Policy, Shipping Policy, and Returns & Warranty Policy, constitute the entire agreement between you and Fox and Talbot.

  • Electronic Communications: By using our website, you consent to receive communications electronically.

    By completing a purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

  2. Intellectual Property and Copyright
    All content on this website, including but not limited to text, product descriptions, condition ratings, photographs, images, graphics, logos, branding, and website layout, is the property of Fox and Talbot or is used under license and is protected by Canadian and international copyright and intellectual property laws.

    No content from this website may be copied, reproduced, distributed, modified, published, transmitted, displayed, or used in any form or for any purpose without the prior written consent of Fox and Talbot. Unauthorized use of website content may result in legal action.
